  4. Volunteers (unpaid) implementing international agreements, with confirmation issued by diplomatic missions/international organizations.

Short-term assignments and international agreements

  1. Managers/executives/experts/technical workers working in Vietnam for up to 30 days per entry/assignment and no more than 3 times per year.
  2. Entering Vietnam to implement an international agreement signed by central/provincial-level agencies/organizations.

Students/interns, relatives, official passports

  1. Students studying abroad who come to Vietnam for internships under approved agreements; also trainees/interns on Vietnamese seagoing ships.
  2. Relatives of members of foreign representative missions in Vietnam.
  3. Holders of official passports working for Vietnamese state agencies or socio-political organizations.

Commercial presence and education confirmation

  1. Persons responsible for establishing a commercial presence.
  2. Foreigners certified by the Ministry of Education and Training to enter Vietnam for teaching/research.

Representative offices, sales activities, urgent technical fixes

  1. Heads of representative offices/projects or the person primarily responsible for operations of international organizations/foreign NGOs in Vietnam.
  2. Entering Vietnam for up to 3 months to conduct marketing/sales activities (e.g., offering goods/services).
  3. Entering Vietnam for up to 3 months to resolve urgent, complex technical/technological incidents that Vietnamese experts cannot handle.

Licensed professions, treaties, family status

  1. Foreign lawyers holding a valid license to practice law in Vietnam.
  2. Exemptions under international treaties to which Vietnam is a party.
  3. Foreigners married to Vietnamese citizens and living in Vietnam.

When you must apply for a work permit exemption certificate

In general, the employer must request certification of exemption from work permit from MOLISA or the relevant provincial DOLISA at least 10 days before the employee starts work.

When notification is enough (no certificate procedure)

Decree 152/2020 also lists specific cases where no certificate procedure is required, but the employer must notify/report to MOLISA/DOLISA at least 3 days before the foreigner starts working, including details like full name, age, nationality, passport number, employer name, and start/end dates.

How to apply for a Vietnam work permit exemption certificate

Step 1: Prepare the dossier

A standard dossier for work permit exemption certification typically includes:

  • Written request using Form No. 09/PLI (Appendix I, Decree 152/2020).
  • Health certificate (per the Decree’s requirements).
  • Document approving demand for foreign labor (unless exempt from demand approval).
  • Certified copy of valid passport.
