Vietnam Visa Overstay Charge: Do You Have to Pay a Penalty? How to Extend Your Visa? And How Much Must You Pay to Return to Vietnam Legally?

These are questions that many foreigners in Vietnam face. Below, Tân Văn Lang updates the latest penalties for visa overstays in 2025 for your reference.

Penalties for Visa Overstay in Vietnam 2025

Notice of increased penalties for overstaying a visa, temporary residence certificate or temporary residence card. From 31/12/2021, the new regulations on administrative violations via Decree 144/2021/ND-CP apply. The changes in penalties for overstaying are as follows:

• Overstay 1 to 15 days: per Point d, Clause 2, Article 18 — fine from VND 500,000 to VND 2,000,000.
• Overstay 16 to 29 days: per Point e, Clause 3, Article 18 — fine from VND 3,000,000 to VND 5,000,000.
• Overstay 30 to 59 days: per Point b, Clause 4, Article 18 — fine from VND 5,000,000 to VND 10,000,000.
• Overstay 60 to 89 days: per Point b, Clause 5, Article 18 — fine from VND 10,000,000 to VND 15,000,000.
• Overstay 90 days or more: per Point d, Clause 6, Article 18 — fine from VND 15,000,000 to VND 20,000,000.

What counts as a visa overstay in Vietnam?

A visa overstay in Vietnam occurs when a foreign national enters Vietnam under a visa-exemption, a temporary residence card, a visa sticker issued by an embassy or an airport entry letter, and remains beyond the permitted stay from even 1 day onward.

Under the new regulations of the Cục Quản lý Xuất nhập cảnh (Immigration Authority) in Vietnam, effective from 01/01/2015, foreigners who stay beyond the visa validity will be subject to administrative sanctions.

When the visa has expired and the foreigner still remains in Vietnam, it is considered staying illegally. According to the immigration authority, in such cases, to extend the visa, apply for a new visa, or to exit Vietnam legally, the foreigner must first pay the fine at the immigration office in Hanoi, Ho Chi Minh City, Da Nang, or at the immigration office in the province/city where the foreigner resides.

Visa extension procedure for Foreigners in Vietnam

If your visa has expired but you still wish to stay in Vietnam for a short time, you may prepare documents for an extension. The dossier and procedures for a visa extension include:

• Original passport with at least 6 months validity.
• Application form for visa extension (Form NA5). See the detailed guide.
• For foreigners entering Vietnam on business (DN) visa: need a sponsorship letter from the Vietnamese company, a labour contract, and temporary residence card.
• For new visa issuance: passport plus photographs.
• For children who have overstayed or need visa extension: birth certificate, and a sponsorship letter by a Vietnamese parent.
• The types of visas that can be extended or newly issued: 1-month once; 3-months once or multiple; 6-months once or multiple; 1-year.

Can a Foreign National Extend if They’ve Overstayed?

A foreigner residing in Vietnam whose visa has expired is required to exit the country and cannot extend the visa in the following cases:

• Entered with a tourist visa (DL)
  
• Entered with an e-visa
  
• Their employment ends with the previous company and they do not have a new company to sponsor them
