IMPORTANT UPDATE: New Policy Effective August 7, 2025

Under the new regulation Decree 219/2025/NĐ-CP [1] (effective August 7, 2025):

  • Faster processing: Work permits are issued within 10 working days from the date a complete file is received. If refused, the authority must reply in writing within 3 working days with reasons.
  • Issuing authority: Provincial People’s Committees handle issuance, re-issuance, extension, and revocation. If a company operates in multiple provinces, the head-office province is in charge.
  • Simplified dossier: The labor-demand explanation is now integrated into the work-permit dossier (Form No. 03).

Eligibility Requirements (Overview)

Per Decree 11/2016/NĐ-CP [2] :

For foreign workers:

  • Appropriate qualifications and relevant experience (skilled worker/expert/manager/executive).
  • Medical certificate meeting Vietnam’s health requirements.
  • Clean criminal record in Vietnam and from abroad.
  • Must fit one of the statutory categories (manager/executive/expert/highly skilled technician).

For the employer (Vietnamese entity):

  • Official approval to employ foreign workers (where required).

For Managers/Executives:

  • Appointment decision and proof of at least 3 years’ experience in the same or equivalent position.

For Experts:

  • Bachelor’s degree (4-year) or higher and proof of at least 3–5 years’ experience in the relevant role.
  • Documents must be consular-legalized as required.

For Technicians:

  • Technical training certificate of at least 1 year and 3–5 years’ experience in the trained field/position.
  • Documents must be consular-legalized.
